Marriage Registration & Prenuptial Agreements in Thailand

For Thai-foreign couples registering their marriage in Hat Yai and Songkhla, from embassy documents to the day at the district office.

In Short

RPN Legal Office in Hat Yai handles marriage registration between Thai nationals and foreigners: the embassy affirmation of freedom to marry, translation and legalization, a bilingual prenuptial agreement drafted under Thai law, and the registration itself at the district office. Legalization can be done at the Department of Consular Affairs office in Songkhla.

Under Thai law a marriage exists only once it is registered under the Civil and Commercial Code. A wedding ceremony alone gives no rights as a spouse: no marital property rights, no inheritance as a spouse, and no marriage visa.

The foreign partner needs embassy documents that must be translated and legalized before filing. Get the order wrong, or let a document expire, and you start again. We sequence everything so it is done in one round. If you want a prenuptial agreement, it must be completed before or at the time of registration.

How Does Marriage Registration Work?

Four Steps
01

02

Embassy & Legalization

Affirmation from your embassy, Thai translation, and legalization at the Department of Consular Affairs.

03

Prenup (Optional)

Agree the property terms, draft in both languages, and sign with witnesses before the registration day.

04

Registration Day

At the district office with documents, interpreter and prenup, so the registrar records it in the marriage register.

When Do You Need a Lawyer to Marry in Thailand?

Couples with complete documents and simple finances can register on their own. Talk to a lawyer before booking the district office if:

  • Either of you has been married or divorced before, especially if the divorce was abroad
  • You have assets, a business, or children from a previous marriage that you want kept separate
  • You plan to buy a house or land in Thailand after marrying
  • The foreign partner will apply for a marriage visa afterwards
  • You are a same-sex couple and need to confirm your embassy will issue the required affirmation

A prenup in the wrong form, or one not recorded in the marriage register, cannot be enforced, and it cannot be changed later without a court order. It is worth getting right from the start.

Frequently Asked Questions

Marriage & Prenup FAQ
What documents does a foreigner need to marry a Thai in Thailand?
The foreign partner needs a passport and an affirmation of freedom to marry from their embassy or consulate, translated into Thai and legalized by the Department of Consular Affairs. The Thai partner needs an ID card and divorce documents if previously married. District offices can ask for different extras, so we check before your appointment.
Can we register our marriage at any district office?
Yes. A marriage can be registered at any district office in Thailand; it does not have to be where either of you is registered as living.
We had a traditional wedding. Do we still need to register?
Under the Civil and Commercial Code, a marriage is valid only once registered. Without registration neither of you has rights as a spouse, such as marital property or inheritance rights, and the foreign partner cannot get a marriage visa.
When must a prenuptial agreement be made?
Before or at the time of registration. It must be in writing, signed by both spouses and at least two witnesses, and recorded in the marriage register. After registration it can only be changed or cancelled with court permission.
Can our prenup say it is governed by my home country's law?
No. A prenup clause applying foreign law to the property relationship is void under Thai law. The agreement must be drafted under Thai law, but we prepare it in both languages so you understand every clause.
Can a foreign spouse buy land and a house with their Thai spouse?
Foreigners generally cannot own land, so land is usually registered to the Thai spouse. In practice the Land Office often asks the foreign spouse to sign a statement that the purchase money is the Thai spouse's personal property. Plan this before buying, as it affects both of you on divorce or death.
Can same-sex couples marry in Thailand if one partner is a foreigner?
Yes, since Thailand's marriage equality law took effect in January 2025. The point to check first is whether the foreign partner's embassy will issue the affirmation of freedom to marry, as practice differs by country.
How much does it cost?
It depends on the scope: registration only, or registration plus a prenuptial agreement. We quote a clear figure before starting. Government, translation and legalization fees are separate and charged at cost.
